Ordered Goods will be shipped to Buyer’s registered shipping address or directly to the designated End User in accordance with DDP incoterms 2020, Partner shall sign a delivery receipt confirmation.
Partner shall be responsible to comply with all applicable export and import laws and regulations and shall ensure that End Users comply with such laws and regulations as provided for in the Contractual Documentation.
Partner may examine the Products promptly upon receipt thereof. No, later than five (5) days after receipt, Partner shall notify Mtech of all claimed shortages or damaged Products, or if the rejection is intended, shall specify all grounds therefor. Failure to give such notice shall be deemed an acceptance of the Products as of the date of shipment.
All risks of loss or damage to Products shall pass to the Partner at the time of delivery to the carrier or shipper. The order shall not be refused for no actual reason.
Assignment of title and ownership of the Products shall occur once payment is made by Partner in full, even if delivery already occurred.
Shipment and/or delivery dates that may be indicated by Mtech are non-binding. Mtech shall not be liable for any delay due to Force Majeure. Orders will be shipped to Partner’s registered shipping address or directly to the designated End User.
Partner may return Products to Mtech or the Manufacturer only with a return material authorization ("RMA") number issued by the Manufacturer.
Buyer may only return erroneously shipped Products
Products that were damaged prior to shipment
Products damaged after shipment may not be returned.
To be eligible to receive credit for returned Products, Buyer must adhere to MTech’s then current returns processing guidelines. Buyer must obtain a valid return authorization number (“RMA”) from MTech concerned sales Manager.
Partner must notify Mtech in writing of any damage to the outer packaging or the Products, shortage, or other discrepancy ("Visual Defect") within five (5) business days after receipt of the shipment; otherwise, Partner is deemed to have accepted the Products.
Partner must notify Mtech in writing stating the specific Product defect within the warranty period. Mtech will only issue an RMA if the defect (either for Visual Defect or for Product Warranty) is created solely by Mtech or the Manufacturer, and only if Partner meets the notice requirement.
Mtech will not grant RMAs for damage, shortage, or other discrepancy created by Partner, the carrier, or the freight provider if the shipment is handled by the Partner or any other third party. Upon receiving the RMA, Partner must return the Products to Mtech in compliance with Mtech ’s instructions in the RMA. Mtech may assess all Products returned by Partner via RMA. If Mtech or the Manufacturer determines such Products are not eligible for a return, Mtech will send such Products back to Partner on a freight collection basis, or hold such Products for Partner's collection and on account at Partner's expense.
The Partner may have the right to reject the Products on Delivery date, however Mtech reserve the right to withhold 15% of the total price paid by the Partner to cover the shipping and return fees, the same will only apply on Products that have been paid online.
